Acceptable Use Policy

This Acceptable Use Policy (our "AUP") applies to anyone who uses the products and services (the "Services") provided by Apodex US, Inc. ("Apodex", "we", "our"), and is intended to help our users stay safe and ensure the Services are used responsibly. This AUP is incorporated into, and forms part of, our Consumer Terms of Service and our Commercial Terms of Service; capitalized terms used but not defined in this AUP have the meaning given in the applicable agreement.

I. Protecting People and Well-being

The use of the Services is strictly prohibited for any activity that causes harm or threatens individuals, including but not limited to:

1. Threats and Harassment: Generating or disseminating any form of threatening, intimidating, harassing, or defamatory content.

2. Self-Harm and Violence: Promoting or assisting suicide, self-harm, eating disorders, or any form of hate-based violence or terrorism.

3. Sexual Violence and Non-Consensual Intimate Content (NCIC): Generating or distributing content related to sexual violence or any non-consensual intimate content.

4. Weapons: Assisting in the development, procurement, or use of any weapons, including conventional weapons or Chemical, Biological, Radiological, and Nuclear (CBRNE) weapons.

II. Illegal and Infringing Activities

The use of the Services is strictly prohibited for any illegal activity or actions that infringe upon the rights of others, including but not limited to:

1. Illegal Goods and Services: Promoting or facilitating the trade of illegal activities, goods, or services.

2. System Compromise: Attempting to compromise, hack, or trespass onto others' systems, networks, or property, including malicious or abusive cyber activity.

3. Intellectual Property Infringement: Infringing upon the copyrights, trademarks, patents, or other intellectual property rights of others.

4. Security Evasion: Attempting to circumvent any security or content protection measures implemented by Apodex.

5. Privacy Violation: Unauthorized dissemination of an individual's private or sensitive information, including "doxxing".

III. Protecting Minors

Minors must be afforded special protection. The use of the Services is strictly prohibited for any behavior that exploits, harms, or sexualizes minors under the age of 18, including but not limited to:

1. Child Sexual Abuse Material (CSAM): Strictly prohibiting the generation, dissemination, or assistance of any CSAM, regardless of whether the content is AI-generated.

2. Grooming: Engaging in behavior intended to lure or groom minors.

3. Inappropriate Exposure: Exposing minors to age-inappropriate content, such as explicit self-harm, pornography, or violence.

We report apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) and/or other competent authorities as required by law, and may preserve related records for that purpose.

IV. Fraud, Misleading Activities, and Abuse

The use of the Services is strictly prohibited for engaging in deceptive or misleading activities, including but not limited to:

1. Deception and Scams: Participating in deception, fraud, scams, or spam activities.

2. Impersonation: Impersonating another individual, entity, or organization.

3. Academic Dishonesty: Engaging in academic misconduct, such as using the Services to complete high-stakes academic tasks in place of the user.

4. Deepfakes and Right of Publicity: Generating the likeness (including photos or voice) or deepfake content of an individual without their consent.

V. High-Risk and Regulated Domains

The use of the Services is strictly prohibited for the following high-risk or professionally regulated activities:

1. Professional Advice: Providing customized advice that requires a license (e.g., medical, legal, financial, or insurance advice) without the proper involvement of licensed professionals.

2. High-Stakes Decision-Making: Unsupervised automated decision-making in sensitive areas such as law enforcement, critical infrastructure management, credit, employment, housing, education, social scoring, or insurance.

3. Real-Time Biometrics: Conducting real-time remote biometric identification in public spaces.

4. National Security and Intelligence: Using the Services for national security or intelligence purposes without explicit review and approval from Apodex.

5. Political Activity: Engaging in targeted political campaigning, lobbying, foreign or domestic election interference, or voter mobilization efforts.

VI. Violation Handling and Appeals

Apodex reserves the right to suspend or terminate a user's access to the Services at any time if Apodex determines that the user has violated this Acceptable Use Policy, applicable laws and regulations, or if the user's activity may pose a risk or harm to Apodex, other users, or any third party. Enforcement under this Acceptable Use Policy is also subject to the suspension and termination provisions of the applicable Consumer Terms of Service or Commercial Terms of Service.
